Top Five Employment Risks You Need to Know

Speaker: Mick Terrell

This fast-paced presentation will discuss the top five employment issues facing employers today: (1) misclassifying employees as exempt versus non-exempt under the FLSA; (2) misclassifying workers as independent contractors; (3) how employee use of social media impacts the workplace; (4) unlawful background checks; and (5) complying with the NLRA in a non-union workplace. Because each of these employment issues presents significant legal risks to employers, awareness and compliance are essential.

Sharpening the Blue Pencil: Is Your Current Non-Competition Agreement Enforceable

Speaker: Anne Cowgur

Employers who use non-competition agreements to protect their business interests seek the maximum protection available to them under the law. In Indiana, employers have been assisted in that effort by application of the blue pencil doctrine, which allows courts to strike unreasonable or overbroad restrictions, leaving an enforceable covenant. Anne Cowgur will discuss the Court of Appeals’ recent decision in Clark’s Sales and Service, Inc. v. Smith, and why employers should reexamine their non-competition agreements following that opinion.

Employers are required to conduct investigations in a number of instances in the workplace. Knowing how to conduct an effective investigation can significantly reduce an employer's potential exposure to legal claims. During this presentation, Tom will address the key elements of an effective workplace investigation, including tips for interviewing witnesses, documentation, and making findings and conclusions.

Chuck O’Keefe will discuss employer obligations under Indiana's wage payment laws. Understanding these obligations is critical because even unintentional or seemingly small mistakes can prove costly to employers. Chuck will address the types of payments to employees that are covered under the law, what is required of employers under the law, the most common mistakes made by employers in administering payments to employees, and how to prevent these potentially costly mistakes.

In this session, Blake Burgan will speak on a selection of hot topics and recent developments in employment law. The presentation will also address how these recent decisions impact your company.
