8:30-9:00 a.m. – NLRB Changes Your Settlement Agreements – and Other Things You Need to Know About Those Agreements

The National Labor Relations Board has found that two very common provisions in Release & Separation Agreements will violate the National Labor Relations Act – by merely presenting an agreement containing those terms to a departing employee. We will discuss the “forbidden” terms and whether employers have any options. This applies to both union and non-union companies. Additionally, we will discuss some key points in using Release and Settlement Agreements in terminations.

10:15-10:45 a.m. – Pregnancy, Related Conditions, and Reasonable Accommodation

The Supreme Court decision in Young v. UPS in 2015 marked a sea of change in employer treatment for pregnancy and related medical conditions. Now, eight years later, the Pregnant Workers Fairness Act and the PUMP Act go even further in protecting pregnant and nursing mothers in the workplace.

10:45-11:15 a.m. – OSHA: What Happened in 2022 and What To Expect in 2023

Although it is not in the rearview mirror just yet, health and safety agencies have begun to shift away from all things COVID. New trends emerged over the past few years, and it was time to get “back to basics” to strengthen workplace safety. Attendees will learn what these trends have been, what OSHA is focusing on in 2023, and tips for making their places of employment safer in the year ahead.

11:15-11:45 a.m. – Can an Employer Effect DEI Initiatives Without Discriminating?

Diversity, equity, and inclusion are important corporate goals. We will discuss whether DEI and complying with discrimination law are mutually exclusive, along with best practices for balancing the two.
