Babbitt Quoted in The American Lawyer

In the verdict, a Chicago attorney and his client were ordered to split a $75,000 bill for intentionally deleting electronic messages pertinent to a lawsuit against Taft client, the Chicago Transit Authority, while the lawyer faces an additional $75,000 sanction for discovery misconduct, a federal judge ruled last week while also dismissing the case.
“We are very pleased with this result,” Babbitt said on behalf of the Chicago Transit Authority. “This case serves as a reminder that the rules of preservation in litigation remain in effect, despite the ever-changing landscape of technology.”
The Chicago Transit Authority was represented by Chicago litigators John Kennedy, Elizabeth Winkowski, Kim Walberg, and Nicollette Khuans.
