Taft partner Phil Schenkenberg and associate Abby Sunberg co-authored the chapter “Trust and Estate Trials and Evidentiary Hearings” for the Minnesota Trust and Estate Litigation Deskbook, published by Minnesota CLE. The chapter provides in-depth guidance on key aspects of trust and estate litigation, focusing on court rules governing probate and trust matters, as well as strategies for handling various trial procedures.

The chapter covers essential topics such as bench and jury trials, pretrial matters, the order and burden of proof at trial, and the examination of witnesses. It also addresses common evidentiary hearings and includes practical advice on objections to evidence and considerations for ending a trial.

Schenkenberg and Sunberg support Taft’s Wealth Transfer Litigation practice group.

Schenkenberg concentrates his litigation practice on fiduciary, probate, and wealth transfer disputes, disputes arising out of closely held businesses, and complicated matters involving telecommunications and technology.

Sunberg litigates fiduciary, probate and wealth transfer disputes, and also supports Taft’s Domestic Relations and Business Litigation practice groups.
