Taft Appellate Group Wins Reversal of Order Blocking Hospital Construction

Taft partners J. Timothy Eaton and Jonathan B. Amarilio, with associate Paul J. Coogan, successfully argued for the reversal of a trial court decision blocking the construction of a hospital in Crystal Lake, Ill., by Taft client Mercy Health Corporation (Mercy Health). The case concerned an effort by Mercy Health’s competitors to block the hospital project in court after failing to block it before the Illinois Health Facilities and Services Review Board, which earlier approved the project. Mercy Health’s competitors persuaded an Illinois trial court to reverse the board’s approval of the hospital project, but Eaton and the Taft appellate team convinced the appellate court to reverse the trial court’s order and reinstate the board’s approval for the project, allowing Mercy Health’s construction to move forward.
