$5 Million Verdict Named to Michigan Lawyers Weekly's 2019 Top Verdicts List
R. Christopher Cataldo was recognized in Michigan Lawyers Weekly’s 2019 Top Verdicts list.
Cataldo’s case representing client Information Systems Intelligence (ISI), LLC was recognized as the No. 6 verdict in the “Verdicts” list for 2019. ISI brought suit against Muskegon County for its breach of the parties’ Managed Services Agreement (MSA) applicable to the County’s computer and related IT systems. The Court granted ISI’s motion for summary disposition as to liability and also dismissed the County’s counterclaim on motion.
The trial was limited to the issue of damages with the Court awarding damages for lost profits under the MSA, lost profits under an amendment to the MSA for additional services and also for profits on lost equipment and software sales. The Court also awarded late charges arising under the MSA.
The Court also granted ISI’s motion for sanctions against the County and its former counsel. With all damages, sanctions and interest included, the total judgment to be entered against the County will exceed $5.1 million.
