Summary

INTELLECTUAL PROPERTY AND UNFAIR COMPETITION
- Represented numerous businesses and individuals in patent, trademark, copyright, and other intellectual property disputes.
- Protected the brand of a 60-year-old Colorado real estate company in a trademark infringement lawsuit, resulting in a $4 million award for the client.
- Successfully represented photojournalist in copyright dispute against movie producer and distributor.
- Obtained favorable settlement for Florida-based entity in trademark infringement lawsuit involving online and Google-based advertising.
- Successfully defended California-based company in trademark infringement lawsuit seeking over $20 million in damages.
- Obtained injunctive relief for a Colorado-based business after its trade secrets had been misappropriated.
BUSINESS TORT LITIGATION
- Represented numerous businesses and individuals in fraud, tortious interference, negligent misrepresentation, and other business tort disputes.
- Awarded $13 million by an arbitration panel for a small Philadelphia-based technology company against one of the largest information technology companies in the world.
- Obtained favorable global settlement in overlapping lawsuits involving fraud, unjust enrichment and estate issues.
- Obtained a favorable settlement on the eve of an arbitration hearing for a Colorado-based wireless company against its wireless technology supplier for claims of breach of contract, fraud and negligent misrepresentation.
- Represented a Colorado-based private equity group in connection with fraud and breach of contract claims relating to acquisition of a company.
- Represented oil and gas company in connection with fraud, tortious interference, and breach of contract claims.
FINANCIAL SERVICES LITIGATION
- Obtained an $11.5 million summary judgment for the servicer of a private lending group against a Colorado commercial real estate developer.
- Successfully obtained summary judgment for a Colorado bank dismissing a Colorado special district’s improper effort to impose and foreclose a $5.4 million “tap fee” lien on 301 undeveloped residential lots that the bank acquired through foreclosure.
- Received partial summary judgment for an electric generation and transmission association in breach of contract dispute involving long-term requirement contracts.
CORPORATE DISPUTE LITIGATION
- Obtained complete defense verdict in favor of an electric generation and transmission company after week-long jury trial for claims of breach of contract involving long-term requirements contracts.
- Received partial summary judgment for an electric generation and transmission association in breach of contract dispute involving long-term all requirement contracts.
- Represented investment fund involving corporate management and control issues between former business partners.
