Summary

Neil is an attorney in Taft’s Intellectual Property practice group. Neil has over 10 years of experience handling intellectual property, domain names, e-commerce, and other internet-related issues. He advises clients on virtually any manner of internet and intellectual property-related matters, and prioritizes finding the right legal approach to achieve business objectives. At Taft, Neil is known as the “internet guy.” His practice focuses on:

  • Problematic domain names (copycat websites, phishing e-mail schemes, impersonation).
  • Social media issues.
  • Infringing websites and website content.
  • E-commerce websites.
  • Enrollment and enforcement of IP on E-commerce platforms.
  • Traditional trademark and copyright issues.
  • Litigation-related internet investigation and evidence collection/preservation.

Intellectual Property

Neil represents clients of all sizes in matters involving the promotion and protection of their intellectual property online. In this capacity, he advises clients and helps them implement comprehensive strategies to protect their intellectual property rights, including through domain name and social media abuse, and aggressively enforces these rights on their behalf.

Neil regularly provides advice to intellectual property owners in the following areas:

  • Recovery or suspension of infringing or abusive domain names, social media handles, and email addresses.
  • Phishing, spamming, and other fraudulent attacks.
  • Trademark and copyright prosecution, protection, and enforcement.
  • Purchase and sale of domain names/social media handles.
  • Removal of problematic website and social media content.
  • SEO and online advertising abuse.
  • Fraudulent or abusive email addresses.
  • Distribution of counterfeit/infringing products online.
  • E-commerce issues.
  • Website terms of use and other policies.
  • ICANN.

E-Commerce
Neil enforces his client’s rights on nearly every E-commerce platform, even prior to the formal inception of enforcement platforms such as Amazon’s Brand Registry, Alibaba’s IPP Platform, eBay’s VeRO Program, etc. This knowledge has become invaluable to clients in navigating the intricacies of each platform’s processes and procedures. Because of his extensive knowledge and experience in this area, Neil was contacted by and worked with Etsy in the creation of the Etsy Reporting Portal. He regularly enforces his client’s rights on these e-commerce platforms.

Domain Names
Neil has recovered or shut down hundreds of problematic domain names, including domain names related to phishing email schemes. In doing so, Neil has acquired extensive knowledge of dispute resolution processes like the Uniform Domain-Name Dispute-Resolution Policy (UDRP) and civil litigation remedies, including the Anticybersquatting Consumer Protection Act (ACPA). He has also helped clients defend against UDRP complaints, including Reverse Domain Name Hijacking.

Social Media
Neil is familiar with the takedown processes and procedures of each social media site, including Instagram, Twitter (X), Facebook (Meta), etc. Whether the content is related to intellectual property infringement or a violation of the platform’s policies (hate speech, inciting violence, defamation), Neil knows how to get the content taken down.

Infringing Web Content
Neil regularly works with internet web hosts to remove websites that infringe his client’s rights. He is well-versed in identifying the relevant web host, understanding its takedown policy and procedure, and ensuring the infringing content is removed.

Litigation

Neil also has complex litigation experience, including class actions and commercial business disputes. Through his multi-jurisdictional trial experience — including trial experience in the Delaware Chancery Court — Neil has engaged in all aspects of the litigation process.

He is instrumental in Taft’s evidentiary research and preservation process. He assists on multiple cases by researching internet-related content and preserving evidence with tools like PageVault. As part of Taft’s Litigation Innovation Committee, Neil is involved in the continued search for tools to assist in this ever-evolving process.

Neil earned his J.D. from Indiana University McKinney School of Law and his undergraduate degree from the University of Southern Indiana. He worked as a law clerk at Taft prior to becoming an attorney.
