Summary

Ryan counsels individual and corporate clients in all areas of intellectual property law, including the preparation, procurement, licensing and enforcement of patents, as well as the drafting and review of licensing and supplier agreements, IP protection clauses and confidentiality and nondisclosure agreements. Another facet of his practice involves patent litigation, where he has assisted clients maneuver through complex patent disputes, including representing clients across a wide array of technology areas before various federal district courts, as well as the Court of Appeals for the Federal Circuit. He has experience representing clients in administrative proceedings instituted at the Patent Trial and Appeal Board (PTAB), including inter partes review (IPR) and Post Grant Review (PGR) proceedings.

Ryan’s practice experience also includes preparing and rendering oral and written patentability, freedom to practice, non-infringement and validity opinions, as well as conducting intellectual property due diligence investigations and audits of usage and ownership. In addition to preparing and facilitating the ongoing prosecution of U.S. patent applications, he has coordinated the filing and prosecution of PCT and national stage foreign patent applications. Ryan has experience working with a diverse range of clients, from small start-up businesses, to Fortune 100 companies. He also has extensive experience assisting with the commercialization of patents through technology transfer offices from major universities and academic institutions, including Purdue University, Indiana University, the University of Cincinnati, Illinois State University, and Rose-Hulman Institute of Technology.

Ryan has experience spanning many technical disciplines, including working with businesses in the biotech, biochemistry, biomedical, chemical, Internet, consumer product, food packaging/processing and mechanical engineering industries. He has also worked extensively with technologies within the medical device and surgical sectors, including orthopedic implants, minimally invasive and computer assisted surgical procedures, bioabsorbable stents, catheter devices, general infusion and pain management pumps, wound closure devices, medical imaging systems, immunoassay platforms, as well as diagnostic workstations and drug delivery devices. In addition to his practice experience within the intellectual property field, Ryan also has worked with clients on various FDA issues, including advising clients on governmental regulatory and compliance related matters.

Ryan is admitted to practice law in both Indiana and Ohio and is registered before the United States Patent and Trademark Office. He is also admitted to practice law before the United States District Court for the Southern District of Ohio, the Court of Appeals for Sixth Circuit and the Court of Appeals for the Federal Circuit.

Notable Matters

  • Handle IP clearance, freedom to operate, due diligence investigations and patent and trademark related matters in the U.S. and abroad for a global medical products and technologies company that focuses on therapies for the management of chronic conditions, with leading market positions in advanced wound care, ostomy care, continence and critical care, and infusion devices. Work for this client includes preparing patent and trademark applications, reviewing invention/inventor disclosures, responding to office actions and prior art searches, among others.
  • Represented a client in a case related to medical patient records tracking software used for managing breastmilk for post-natal patients with children in the hospital. This case originally covered the entire spectrum of IP law with patent, copyright and trade secret components, and our team team was able to resolve the issue through a settlement negotiation via the copyright claims.
  • Assisted a medical device company in a patent infringement case related to atraumatic trocar apparatuses, which are used to reduce tissue trauma and bleeding during surgical procedures. Taft helped the client negotiate a favorable settlement without needing to go to trial.
  • Assisted a client in a patent infringement case related to an alleged infringement of a wildlife supplies product patent. We served as local counsel for the defendant and were able to resolve this matter by negotiating a settlement to help avoid the expense of going to trial.
  • Assisted a client in successfully resolving a patent infringement case in related to a patented multifunction chair.
